Maintain Residential Status for Westhaven Estates Deed Restrictions

This weekend a young couple came to my door canvassing for signatures to allow their photography company to operate as a commercial enterprise in Westhaven Estates on San Felipe. The address is 6104 San Felipe. They do not live on the premises. I have seen days when there have been 4 or 5 cars parked in a lot in their front yard and several more in the back. They run a business. It would be so easy to “help” them by signing their petition to allow an exception for them.
I have appealed to the City of Houston’s Attorneys office to help when 3 other attempts were made to use San Felipe properties for commercial purposes. They told me that it was a good thing that we were actively involved in maintaining our deed restrictions and in fact, sent notice to the offending owner to cease and desist.
It is easy to think, oh well, it’s okay for San Felipe to become commercial. It doesn’t bother the rest of us. But, I ask you, what if it was your home, your investment, your homestead for many years that backed up to it. And Westhaven Estates deed restrictions limit the height of a home–how many builders do you think have requested an exception to build 4 or maybe 5 stories. And how will you feel when there is a highrise in your back yard? It’s happening down the street. Those homeowners agreed to an exception in their deed restrictions.
Please, I ask of you, please decline to sign this or any petition for an exception to our deed restrictions. We are so lucky that the City of Houston will actively help us fight infringements.
